Terms of Service

Please read these Terms of Service carefully before using the Grampians.AI platform. These Terms govern your access to and use of our AI-powered phone receptionist service, including all associated features, tools, and content.

1. Acceptance of Terms

By creating an account or using the Grampians.AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

These Terms constitute a legally binding agreement between you and Grampians.AI Pty Ltd (ABN pending), a company registered in Victoria, Australia. If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Grampians.AI provides an AI-powered phone receptionist platform that:

- Answers inbound phone calls on behalf of your business using artificial intelligence.

• Books appointments by integrating with Google Calendar.

• Takes messages and delivers them via your dashboard and optional SMS/email alerts.

• Provides call analytics, transcriptions, and AI-generated summaries.

• Assigns a dedicated Australian phone number to your business.

The Service is provided on a subscription basis with tiered pricing. Features and call minute allowances vary by plan. You acknowledge that the AI receptionist, while advanced, is not a substitute for human judgement in all situations.

3. Billing & Subscriptions

Subscription Plans — You select a plan during onboarding. Plans are billed monthly in Australian Dollars (AUD), exclusive of GST. Prices are as displayed on our website at the time of purchase.

Payment Processing — All payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.

Overage Charges — If your call usage exceeds your plan's included minutes, overage charges apply at the per-minute rate specified in your plan. Overage is billed at the end of each billing cycle.

Plan Changes — You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the start of your next billing cycle.

Cancellation — You may cancel your subscription at any time from your dashboard. Upon cancellation, your service continues until the end of the current billing period. No refunds are provided for partial months.

GST — All prices are exclusive of GST. GST will be added where applicable in accordance with Australian tax law.

4. Acceptable Use

You agree not to use the Service to:

- Engage in any unlawful, fraudulent, or deceptive activities.

• Transmit spam, unsolicited communications, or automated bulk messaging.

• Impersonate another person or entity.

• Interfere with or disrupt the Service, servers, or networks.

• Attempt to gain unauthorised access to any part of the Service.

• Use the AI receptionist to provide medical, legal, or financial advice.

• Record calls in jurisdictions where such recording is prohibited without consent.

We reserve the right to suspend or terminate your account if you violate these terms, without notice or refund.

5. Limitation of Liability

To the maximum extent permitted by Australian law:

No Warranty — The Service is provided "as is" and "as available." We do not guarantee that the AI will handle every call perfectly, that appointments will always be booked correctly, or that the Service will be uninterrupted.

Limitation — Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Exclusions — We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.

Australian Consumer Law — Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) which cannot be excluded, restricted, or modified by agreement.

6. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

- Post the updated Terms on this page with a revised "Last updated" date.

• Notify you via email or an in-app notification at least 14 days before the changes take effect.

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the effective date.
